Purchase of Digital Gold

• b. RKS DigiGold is not liable for any inaccuracies or errors in the information provided by the user.
• c. Digital gold transactions are subject to market fluctuations, and users acknowledge the inherent risks involved.

Saving Gold with RKS DigiGold

• a. Users can save digital gold securely on the RKS DigiGold platform.
• b. RKS DigiGold employs industry-standard security measures, but users are responsible for maintaining the confidentiality of their account credentials.
• c. Users can track and manage their saved gold through the platform's account management features.

Selling Your Gold

• a. Users can sell their digital gold holdings through the RKS DigiGold platform.
• b. The selling process is subject to not applicable any fees and GST in transaction terms.
• c. Users must provide accurate withdrawal information for the proceeds of the sale.
• d. In the case of unnecessary money withdrawal requests, the company will establish specific guidelines that users must agree to. 
• e.Frequent withdrawal requests, especially those made immediately after deposits, are considered against our company policies. 
• f. Users must adhere to the company's withdrawal policies when requesting withdrawal.

Transaction Fees

• a. RKS DigiGold reserves the right to charge Goods and Services Tax (GST) for purchase and saving gold transactions conducted on the platform.
• b. Users should be aware that GST rates may apply based on prevailing regulations.
• c. Users will be provided with clear and comprehensive information about any applicable fees before finalizing transactions on RKS DigiGold.

Eligibility

By using our Services, you affirm that you are at least 18 years old and legally qualified to enter into a binding contract under Indian law, including the Indian Contract Act, 1872. If ineligible, kindly cease using the Platform. If you're a parent or guardian registering a user under 18, you consent to their registration and agree to these Terms and Conditions.

You confirm your legal capacity to buy and sell gold and that you are currently not registered under the Goods and Services Tax Act, 2017. Any change in your GST registration must be promptly communicated to RKS DigiGold within 24 hours. The Company is not liable for actions taken by RKS DigiGold due to changes in your GST status. Seek independent tax advice; these terms do not constitute tax advice.

Registration

To access our Services, register on the Platform by providing essential information, including name, age, gender, and a verified mobile number. Financial details may be required for payment processing.

Ensure prompt updates to account information and refrain from providing false details to prevent potential account suspension. By registering, you agree to abide by the Terms and Conditions, privacy policy, and take full responsibility for account activities.

Consent to receive Platform-related communications is implied with registration. Notify the Company promptly of any unauthorized account use. The Company reserves the right to refuse service, terminate accounts, or cancel orders at its discretion. Failure to comply may result in liability for losses incurred.

Platform Services

By registering on the Platform, you are granted a limited, non-transferable license to use it for purchasing Gold as part of the collaboration between the Company and RKS DigiGold Gold. The Platform Services include facilitating the buying and selling of Gold, maintaining personal and financial transaction records securely, and intelligent updates for savings goals.

KYC documentation may be required before availing of Services, and the Platform does not assume liability for any services offered by RKS DigiGold Gold. You agree that data on the Platform is not investment advice, and the Company is not responsible for any loss or damage due to platform use or investments made.

KYC Verification

Before placing orders and availing services, users may be required to provide specific KYC documentation and other information as deemed fit by RKS DigiGold.

KYC Process

The KYC verification process is based on the PAN Card issued to you. You're required to upload a clear picture of your PAN Card, unless an e-PAN is provided. The Company will verify your details from the database of the issuing authority, including through Digilocker. In case you do not have a PAN Card, Form 60 can be submitted.

Terms and Conditions of RKS DigiGold

It is essential to note that any services offered, including the purchase, sale, or transfer of Gold on RKS DigiGold's platform, are governed by the specific terms and conditions of RKS DigiGold. These terms can be accessed at RKS DigiGold's Terms and Conditions.

Company's Role and Disclaimer

The Company serves as a facilitator, providing a platform for users to transact and invest in Gold. However, the Company holds no liability for the products and/or services offered by RKS DigiGold. Users acknowledge that the data and information provided on the Platform do not constitute advice and shall not be relied upon for making investment decisions. Users are solely responsible for their investment decisions and Gold purchases. The Company shall not be liable for any loss or damage arising from the use of the Platform or investments made through it.

Feedback and Reviews

As part of the Platform Services, users agree to provide honest feedback and reviews about the concerned Platform Service when required or requested by the Company.

Pricing & Payment Policy

Market-Linked Gold Prices

Unless stated otherwise, the price displayed on the Platform represents the market-linked price of Gold, reflecting prices in the commercial bullion market in India. It's important to note that these prices may vary multiple times within a day. As a purchaser, it is your responsibility to compare prices and make informed decisions after due diligence.

Payment Policy

Payment for Customer Orders will be accepted through the payment options available on the Platform. This may include redirection to third-party payment gateways and aggregators, such as UPI payments through PhonePe (https//www.phonepe.com/) and Paytm (https//paytm.com/). Taxes applicable as per government regulations will be charged at the time of purchase, sale, and/or transfer of Gold.

Terms and Conditions of RKS DigiGold

Please be aware that payment terms, delivery, warranty, and cancellation/refund policy are subject to the terms and conditions of RKS DigiGold.

Transaction Completion

Transactions on the Platform will be considered complete only after successful money transfer to the company's bank account, either from your registered bank account or the escrow account maintained by the Company. The corresponding gold quantity will be credited to your RKS DigiGold Account within 5 (five) business days from the successful transfer date. It's crucial to fully understand the terms of the custodian and trusteeship arrangement before making any investment. Refer to RKS DigiGold Terms and Conditions.

Your Obligations & Responsibilities

Compliance with Terms and Conditions

While accessing our Platform, you must comply with these Terms and Conditions and any special warnings or instructions provided on the Platform or RKS DigiGold.

Platform Integrity

You are prohibited from making any changes to the Platform, Content, or Services that could compromise its integrity or operation.

Adherence to Laws and Good Faith

Act in accordance with existing laws, customs, and good faith principles during your use of the Platform.

Representations and Warranties

• Payments are made from your legitimate bank account through approved channels.
• Seek independent professional advice before making investment decisions.
• RKS DigiGold offer documents and terms and conditions.
• Will not sell, trade, or transfer your registered account to another party or impersonate anyone for account creation.

Liability Acknowledgment

You acknowledge that you are solely liable for all acts, including providing UPI details, phone numbers, email addresses, bank account details, addresses, etc. Any default in obligations outlined in these Terms and Conditions makes you liable for losses and damages incurred by the Platform, Company, partners, or licensors.

Gold Rights

Ownership and Control

The Platform, along with all its information, content, materials, and products, is owned and controlled by the Company. The design, structure, selection, and arrangement of content are protected by copyright, patent, trademark laws, and other applicable intellectual property rights, either owned by the Company or third parties with appropriate permissions.
